These Terms of Use (“Terms”) apply to your use of the Own Orbit app and its widgets, developed and published by Shuyi Zhao (“we”, “us”, “our”). Own Orbit is distributed through Apple’s App Store.
Your license to use Own Orbit is governed by Apple’s Standard End User License Agreement for apps made available through the App Store (“Apple EULA”):
https://www.apple.com/legal/internet-services/itunes/dev/stdeula/
These Terms supplement the Apple EULA. If these Terms conflict with the Apple EULA on the scope of your license, the Apple EULA controls. You acknowledge that Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, Apple has the right to enforce these Terms against you.
By downloading, purchasing, or using Own Orbit, you agree to these Terms.
Own Orbit is an offline-first personal planner for iPhone and iPad. It helps you keep tasks in lists and folders with dates, repeats and reminders, see them next to the events from your device’s calendars, check in habits and follow their streaks, and keep a Shelf of the movies, TV series and books you want to watch or read, are in the middle of, or have finished. It includes Home Screen and Lock Screen widgets and can optionally sync through iCloud.
Own Orbit is a personal organization tool. It is not a calendar service, alarm, medical or health product, coaching service, or any kind of guarantee that you will not miss a task, appointment, or deadline.
To use Own Orbit, you must be old enough to form a binding agreement in your country and meet the minimum age required by Apple’s App Store terms in your region.
You are responsible for:
Do not use Own Orbit for illegal activity, to infringe another person’s rights, or in a way that interferes with the app, related services, or the servers that host subscribed calendars.
Own Orbit is free to download and use. Without a purchase, the app limits you to five lists (the Inbox counts as one), three active habits, and three Shelf items per type (hidden types included), and offers the Today widget only. These limits only stop you from adding more; nothing you already have is ever deleted, hidden, or locked because of them.
Own Orbit may offer a one-time, non-consumable in-app purchase called Own Orbit Pro. It is not a subscription and does not auto-renew. Own Orbit Pro removes those limits and unlocks your own Shelf types, subscribed calendars, iCloud Sync (including Delete iCloud Data), and every widget.
Purchases are processed by Apple through the App Store. Apple handles payment, taxes, receipts, refunds, family sharing eligibility, and purchase restoration according to Apple’s terms and policies. We do not receive your payment card details, and we cannot issue refunds directly — refund requests go through Apple. You can restore a previous purchase with “Restore Purchases” on the Own Orbit Pro screen.
The App Store is checked each time the app opens. If Apple revokes or refunds your purchase, Pro features lock again: subscribed calendars are kept but hidden, your own Shelf types and their items stay and can still be edited, iCloud Sync pauses, and Pro widgets ask you to unlock Pro. Your existing data is never deleted because of a limit or a lapsed purchase.
Feature availability may depend on your device, iOS version, Apple ID, iCloud availability, App Store availability, and whether Apple reports an active entitlement for your purchase.
Own Orbit shows events from your device’s calendars only if you grant calendar access, and only reads them. It never creates, changes, or deletes events, and it does not store them.
Subscribed calendars (Pro) are downloaded from web addresses that you provide, and their content comes from third parties, not from us. We do not control, review, or guarantee that content, its accuracy, or its availability. A subscribed calendar may fail to refresh, change, or disappear; Own Orbit keeps showing the last copy it downloaded successfully and warns you after repeated failures. Your use of a calendar’s content may be subject to the terms of whoever publishes it.
iCloud Sync is optional and requires Own Orbit Pro, an Apple ID, iCloud availability, and the app’s sync setting to be turned on.
When iCloud Sync is on, your Own Orbit data may sync across devices connected to the same Apple ID. Changes made on one device may appear on other synced devices. If the same record is edited on two devices around the same time, one version wins in its entirety; Own Orbit checks for and repairs certain conflicts after syncing (for example, duplicate records created on two devices) and tells you when it has adjusted something. Deleting or editing data while sync is on may affect other synced devices.
Enabling sync lets you either keep this device’s data and merge it with iCloud, or replace this device’s data with what is in iCloud (“Restore Existing iCloud Data”). Review the prompt carefully before choosing; replacing cannot be undone. Turning sync on or off takes effect after the app restarts. To limit risk, “Delete iCloud Data” is only available while iCloud Sync is turned off, and Own Orbit does not offer a “delete everything on this device” action, so a single action cannot unexpectedly empty your device, your iCloud account, and your other devices at once.
Apple operates iCloud and CloudKit. Your use of iCloud is governed by Apple’s applicable terms and privacy policies.
Your Own Orbit data belongs to you. Own Orbit does not collect it (see the Privacy Policy).
Own Orbit does not provide export, import, or backup files. Before certain destructive actions (Delete iCloud Data and Restore Existing iCloud Data) it saves a local safety copy on your device as a precaution, but this is an internal safeguard and not a backup service; you should not rely on it to recover your data. Your device’s own backups made through Apple’s tools may include Own Orbit’s data, and you are responsible for keeping them if you want a copy.
Delete iCloud Data and Restore Existing iCloud Data can permanently change or remove records. Deleting the app removes its data from that device but not from your iCloud account. Review confirmation prompts carefully before continuing.
Own Orbit does not provide medical, health, fitness, psychological, productivity-coaching, legal, or other professional advice. Habit streaks, completion rates, and other figures are simple calculations from what you record, for personal motivation only. Talk to a qualified professional before starting or changing any health-related routine.
Own Orbit’s privacy practices are described in the Own Orbit Privacy Policy. Please review it to understand how the app stores data locally, reads your calendars, downloads subscribed calendars, handles cover photos and notifications, uses optional iCloud Sync, and processes purchases through Apple.
Own Orbit, including its design, code, text, graphics, icons, and related materials, is owned by us or licensed to us. These Terms do not transfer ownership of Own Orbit to you.
You keep ownership of the content you create in the app, including your notes and photos. Because Own Orbit does not collect your content, you do not grant us any license to it.
You may use Own Orbit only as permitted by these Terms, Apple’s applicable terms, and applicable law.
We may update, change, suspend, or discontinue features of Own Orbit at any time. We may also update these Terms when the app, App Store requirements, or legal requirements change. If we make material changes, we will update the “Last updated” date above. Continued use of Own Orbit after updated Terms are made available means you accept the updated Terms.
To the maximum extent permitted by law, Own Orbit is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory. We do not guarantee that the app will be error-free, uninterrupted, compatible with every device or iOS version, or that data, reminder, notification, calendar, subscribed-calendar, widget, sync, restore, photo, or purchase features will always work as expected, or that using the app will prevent you from missing anything.
Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, loss of profits, business interruption, device issues, iCloud issues, App Store issues, inaccurate records, reminders or notifications that did not fire or fired at the wrong time, incorrect or unavailable calendar or subscribed-calendar content, failed sync or restore, missed tasks, appointments, or deadlines, or decisions made using the app.
Nothing in these Terms limits or excludes liability where doing so is not permitted by law. If you are a consumer, you keep all rights granted to you by the mandatory consumer-protection laws of your country of residence, and nothing in these Terms reduces those rights.
You may stop using Own Orbit at any time. Your rights to use Own Orbit may end if you violate these Terms or Apple’s applicable terms. Pro purchase rights are also subject to Apple’s App Store rules and entitlement systems.
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce any provision is not a waiver of it. These Terms, together with the Apple EULA and the Own Orbit Privacy Policy, are the entire agreement between you and us regarding Own Orbit.
